European Council and the Treaties of the European Union
Description of European Council provided by the European Union Commission: The European Council is the term used to describe the regular meetings of the Heads of State or Government of the European Union Member States. Its purpose is to provide the Union with the necessary impetus for its development and to define its general political guidelines. It does not issue legislation. It was set up by the communiqué issued at the close of the December 1974 Paris Summit and first met in 1975. Before that time, from 1961 to 1974, the practice had been to hold European summit conferences. Its existence was given legal recognition by the Single European Act (1986), while official status was conferred on it by the Treaty on European Union (Maastricht, 1992). It meets at least twice a year and the President of the European Commission attends as a full member. It is chaired by the Member State holding the presidency of the Council of the European Union in a predetermined order. The European Constitution currently being ratified provides for the European Council to gain full status as a European institution. It also provides for changes to the presidency system by establishing the function of permanent President of the European Council, elected for a term of two and a half years.

It should not be confused with:
the Council of the European Union (also known as the Council or Consilium in Latin), the EU's main decision-making body consisting of national ministers, one for each Member State, with both executive and legislative powers;
the Council of Europe, a 47-member non-EU organisation of nearly all European countries.

In the context of trade organizations, Christopher Mark (1993) provided the following definition of European Council: The semiannual summit meeting of EC leaders, which functions as the supreme level of decision making in the Community .As such, it is distinct from the EC Council of Ministers,which prepares its agenda. Each member state is represented by its prime minister except for France, which is represented by its president. European Council meetings last two or three days, and are hosted by the country currently holding the presidency of the Council of Ministers.
