"My Wife, Anna Jones," Divorce, Insurance
From the book The Clergyman's Hand-book of Law, about "My Wife, Anna Jones," Divorce, Insurance (1): A bequest or devise to "my wife, Anna Jones," is not changed by a divorce without some evidence to prove that the testator did not intend his divorced wife to share in his estate, unless the judgment of divorce made a division of the property. The same is true of a policy of insurance or benefit certificate
. However, there are exceptions that weaken the rule and make its application in some States uncertain (Lansing v. Haynes, 95 Mich., 16; 54 N. W., 699; Baacke v. Baacke, 50 Neb., 18; 69 N., 303; Jones, Jr., estate, 211 Pa., 364; 60 At., 915; 69 L. R. A., 940; White v. B. of A. Y., 124 Ia., 293; 99 N. W., 1071; 66 L. R. A., 164.).
